TERMS AND CONDITIONS OF USE

These Terms and Conditions of Use govern access to and use of the digital platform marketed under the name E-DOLLS hereinafter, the “Platform”, operated by AI Analytics S.L., including its editorial content, digital magazine features, artificial intelligence tools, subscriptions, credits, and associated services.

By accessing, browsing, registering for, subscribing to, or otherwise using the Platform, the user expressly accepts these Terms. If the user does not agree with them, they must refrain from using the Platform.

1. APPLICABLE CONTRACTUAL DOCUMENTATION

These Terms constitute the main contract between the user and AI Analytics S.L. in relation to the use of E-DOLLS.

The following documents form part of the contractual framework and must be interpreted consistently with these Terms:

In the event of any contradiction between these Terms and any supplementary document, these Terms shall prevail, unless mandatory applicable law provides otherwise.

2. SERVICE PROVIDER IDENTIFICATION

E-DOLLS is a digital platform operated by AI Analytics S.L., a company established in Spain.

For legal, administrative, contractual, or support communications, users may contact AI Analytics S.L. through the contact channels made available on the Platform, including the email address indicated on the website.

3. SERVICE DESCRIPTION

E-DOLLS is a digital platform that combines an online magazine focused on fashion, visual culture, and artistic photography with a SaaS environment for artificial intelligence assisted image generation, editing, and processing.

The Platform may include, among other features:

• Editorial articles, visual galleries, and magazine-style content related to fashion, photography, image culture, and creative production.
• Image generation, editing, enhancement, and processing tools powered by artificial intelligence systems.
• Account-based access to private galleries, saved outputs, subscription features, and credit-based usage.
• Technical integrations with third-party APIs and external infrastructure providers necessary for the operation of the service.

AI Analytics S.L. provides access to the Platform and coordinates the user interface, account system, credits, and service experience. Certain technical processes may be performed by external providers through APIs or other integrated services.

4. ACCESS, ACCOUNT, AND LEGAL CAPACITY

The user declares and guarantees that they have sufficient legal capacity to enter into these Terms and to use paid digital services. Where the Platform requires a minimum age or account verification, the user must comply with such requirements.

The user is responsible for keeping their login credentials confidential and for all activity carried out through their account, except where such activity results from a security breach attributable to the Platform.

AI Analytics S.L. may suspend, restrict, or terminate accounts where there is evidence of breach of these Terms, unlawful use, security risk, payment irregularity, or misuse of the Platform.

5. EDITORIAL CONTENT OF E-DOLLS

Editorial content published through E-DOLLS is provided for artistic, informational, inspirational, and magazine-style purposes related to fashion, photography, visual aesthetics, and creative image culture.

Editorial images, articles, galleries, examples, and visual materials may be created, edited, assisted, or enhanced using artificial intelligence or other digital tools. Such content is not intended to identify, impersonate, or reproduce any real person unless expressly stated and lawfully authorized.

AI Analytics S.L. reserves all rights over the Platform, its design, brand elements, editorial texts, software, interfaces, databases, and proprietary visual materials, except where third-party rights or user rights apply.

6. USER-GENERATED CONTENT AND UPLOADED MATERIALS

Users may generate images from prompts, edit existing images, upload their own materials for processing, and save outputs in their private account areas where such functionality is available.

The user is solely responsible for the prompts, instructions, files, images, and other materials they upload, generate, edit, or process through the Platform.

The user declares that they hold the necessary rights, permissions, and lawful basis to upload, process, transform, or use any materials submitted to the Platform, including any images or elements relating to third parties.

AI Analytics S.L. may access user-generated content or uploaded materials only where reasonably necessary for technical operation, support, system security, legal compliance, fraud prevention, enforcement of these Terms, or cooperation with competent authorities. This does not imply systematic prior review of all private user content.

7. ACCEPTABLE USE OF THE PLATFORM

The user agrees to use the Platform only for lawful, legitimate, and permitted purposes. The following uses are prohibited:

• Using the Platform in breach of applicable law, court orders, administrative requirements, or third-party rights.
• Uploading, generating, editing, or distributing content that infringes intellectual property, privacy, publicity, image, honor, or data protection rights.
• Using real images, likenesses, names, or identifying elements of third parties without a valid legal basis or consent where required.
• Creating or processing content involving minors in a harmful, exploitative, deceptive, or unlawful context.
• Creating non-consensual, defamatory, harassing, threatening, discriminatory, or privacy-invasive content.
• Attempting to bypass usage limits, payment systems, security measures, filters, rate limits, or technical restrictions.
• Using the Platform for fraud, impersonation, phishing, malware, automated abuse, scraping, reverse engineering, or disruption of service.
• Reselling, sublicensing, or commercially exploiting access to the Platform without prior written authorization from AI Analytics S.L.

AI Analytics S.L. may take reasonable technical, contractual, or account-related measures to prevent misuse, protect the Platform, and comply with legal obligations.

8. ARTIFICIAL INTELLIGENCE TOOLS AND THIRD-PARTY SERVICES

The Platform includes tools based on automated artificial intelligence systems and third-party APIs.

Outputs may vary depending on user instructions, model behavior, external provider availability, system load, updates, safety rules, and technical limitations.

AI Analytics S.L. does not guarantee that AI-generated or AI-edited outputs will be accurate, unique, error-free, suitable for a specific purpose, or free from visual inconsistencies.

The user is responsible for reviewing outputs before using, publishing, sharing, or relying on them. AI outputs must not be treated as professional advice, legal assessment, technical certification, or factual verification.

9. SUBSCRIPTIONS, CREDITS, DIGITAL ACCESS, AND REFUNDS

Access to certain Platform features may require a paid subscription, one-time purchase, or credit package. Credits may be consumed when the user requests image generation, editing, processing, enhancement, or other credit-based operations.

Unless otherwise stated, credits, subscriptions, and paid features are digital services or digital content made available immediately or shortly after purchase.

Where the user subscribes, purchases credits, consumes credits, initiates a digital process, downloads or saves generated outputs, or accesses exclusive paid content or features, the corresponding digital service shall be considered to have begun or been provided.

Once credits have been consumed or exclusive paid content or features have been accessed, refunds are not available, except where required by mandatory applicable law or where AI Analytics S.L. confirms a verifiable technical failure or billing error attributable to the Platform.

Further details are governed by the Refund Policy, which forms part of the contractual documentation applicable to the Platform.

10. STORAGE AND AVAILABILITY OF IMAGES

Images uploaded solely for reference or temporary processing may be automatically deleted after the relevant process is completed, unless the Platform expressly provides a saving or gallery function.

Generated or edited outputs saved in the user account may be stored for a limited period, which may be up to six (6) months unless otherwise stated, deleted earlier by the user, or removed for technical, legal, security, or policy reasons.

AI Analytics S.L. does not guarantee indefinite storage of user content. Users are responsible for downloading and backing up any outputs they wish to keep.

11. INTELLECTUAL PROPERTY

User content

Subject to applicable law and third-party rights, the user retains the rights they may hold over the images, prompts, files, and outputs they create or upload through the Platform.

By using the Platform, the user grants AI Analytics S.L. a limited, non-exclusive, worldwide license to host, process, transmit, reproduce, adapt technically, display within the user account, and otherwise use submitted materials only as necessary to provide, secure, maintain, and improve the Platform, comply with legal obligations, and enforce these Terms.

Platform content

The E-DOLLS brand, interface, software, design, editorial materials, texts, databases, visual layout, and proprietary content are owned by or licensed to AI Analytics S.L. and are protected by intellectual property laws. Their reproduction, distribution, public communication, transformation, or exploitation without authorization is prohibited.

12. MODERATION, SECURITY, AND ACCOUNT MEASURES

AI Analytics S.L. does not perform systematic prior review of all user-generated content. However, it may review, restrict, remove, or block content, outputs, accounts, or access where reasonably necessary to protect users, third parties, the Platform, or legal compliance.

Measures may include warnings, credit adjustments, temporary restrictions, suspension, termination, refusal of service, preservation of relevant records, or cooperation with competent authorities where legally required.

13. DATA PROTECTION AND PRIVACY

Personal data is processed in accordance with the Privacy Policy and applicable data protection law, including the GDPR where applicable.

The user acknowledges that use of AI tools, payment systems, hosting infrastructure, and security systems may involve processing by external providers necessary for the operation of the Platform.

14. LIMITATION OF LIABILITY

The Platform is provided on an as-available basis. AI Analytics S.L. does not guarantee uninterrupted availability, error-free operation, compatibility with every device or browser, permanent access to external providers, or specific results from AI tools.

To the maximum extent permitted by applicable law, AI Analytics S.L. shall not be liable for indirect damages, loss of profits, loss of data, business interruption, misuse of the Platform by users, unlawful use of third-party materials, or failures caused by external providers, force majeure, or circumstances outside its reasonable control.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory consumer protection law or other applicable mandatory rules.

15. MODIFICATIONS TO THE PLATFORM AND TERMS

AI Analytics S.L. may update, modify, suspend, replace, or discontinue features of the Platform for legal, technical, security, business, or operational reasons.

These Terms may be updated from time to time. Relevant changes will be communicated by reasonable means where required. Continued use of the Platform after changes become effective implies acceptance of the updated Terms, unless mandatory law provides otherwise.

16. APPLICABLE LAW AND JURISDICTION

These Terms are governed by Spanish law, without prejudice to any mandatory consumer protection rules that may apply to users in their country of residence.

For any dispute arising from access to or use of the Platform, the parties shall submit to the competent Courts and Tribunals of Spain, unless mandatory applicable law establishes another competent jurisdiction.
